Delhi Red Fort Blast: The Delhi High Court on Friday refused to grant permission for Red Fort blast co-accused Jasir Bilal Wani to meet with his lawyer at the National Investigation Agency (NIA) headquarters.

Justice Swarana Kanta Sharma observed that the accused had failed to present any order from the trial court rejecting his request to meet his lawyer at the NIA office.

The court emphasized that there was a prescribed legal process to follow, and that no special procedure could be created for an individual accused. "You think that I am going to make my own procedure? I would not. This is not a special one," the judge stated.

This comment came after Wani's counsel argued that the trial court had orally rejected their application to allow the meeting. Justice Sharma, however, made it clear: "There cannot be any oral rejection. Why are you before me if you do not have the order? First, the order of rejection has to be passed, then you can challenge it before me... There is a constitutional process which we all follow."

Wani was arrested by the NIA on November 17, accused of being an "active co-conspirator" in the Red Fort car blast, which occurred on November 10 and resulted in over 10 deaths. The following day, the trial court remanded him to 10 days in NIA custody.

During the hearing, Wani's lawyer claimed that an attempt had been made by a lawyer to meet the accused at the NIA office, but the agency had denied the meeting, requesting a court order. When the lawyer approached the trial court with a formal application for permission, the court allegedly orally rejected it, denying the legal 'mulaqat'.

In response, the NIA's counsel argued that Wani had not exhausted all available legal remedies before approaching the high court and requested the petition to be dismissed.

The high court, while rejecting the petition, found that the accused had not pursued all available legal avenues. The fact that the trial court had either not recorded the application or had orally refused to pass an order was not sufficient grounds for the high court to intervene.

However, the court gave Wani's counsel the option to approach the trial court again on Saturday to have the matter adjudicated in accordance with the law.

A resident of Qazigund in Anantnag, Wani was arrested in Srinagar on November 17 for allegedly providing technical support for carrying out terror attacks by modifying drones and attempting to make rockets ahead of the bomb blast, the NIA had said in a statement.

It has termed Wani an alleged active co-conspirator behind the attack, who worked closely with the terrorist, Umar Un Nabi, to plan the "terror carnage". Six people have been arrested by the NIA so far in connection with the 'white collar' terror plot.

Besides Wani, the other five arrested persons are key accused Amir Rashid Ali and doctors Muzammil Ganaie, Adeel Rather and Shaheena Saeed, besides preacher Maulvi Irfan Ahmed Wagay. They all are presently in NIA custody.
