SC Ruling

"All Scheduled Castes and ST Scheduled Tribes communities are not a uniform group. Some castes may be more backward than others. For example, those involved in sewer cleaning and weaving. Both of these belong to the SC category, but people from these castes are often more backwards compared to others. To uplift these communities, state governments can classify (sub-categorize) the SC-ST reservation and set a separate quota for them. Doing so is not against Article 341 of the Constitution," the top court had noted.

The Supreme Court, while allowing the decision to set quotas within quotas, also gave important instructions to the states. It stated that state governments cannot make this decision arbitrarily. It said certain conditions must be applied in this regard. These conditions included-- a state cannot allocate 100 per cent of the quota to any single caste within the SC category and before determining the quota for any caste included in the SC category, there must be solid data supporting its proportionate representation.

The Dalit organisations that have called for the Bharat Bandh are demanding that the Supreme Court should reconsider its decision on quota within quota. No state government has officially issued guidelines regarding the Bharat Bandh yet. However, authorities are taking extensive measures to ensure public safety during the protests.
