In a letter to Chief Justice of India Sanjiv Khanna, the Allahabad High Court Bar Association expressed objection to the proposed transfer of Delhi High Court Justice Yashwant Verma to the Allahabad High Court amid the controversy over the alleged recovery of a substantial sum of money from his residence.
According to a report by Live Law, the bar body declared in the strongly worded statement that they were against corruption and that they were not a 'trash bin'.
“This decision of the collegium of the Supreme Court raises a serious question as to whether the Allahabad High Court is trash bin? This matter becomes important when we examine the current situation wherein the Allahabad High Court is short of hon’ble judges and despite the continuous problems, new judges have not appointed since last many years," the letter said.
"It is also of grave concern that while appointing judges by elevating members of the Bar, the Bar was never consulted. Consideration of eligibility appears to be not up to the mark. Something is lacking which has resulted in corruption and consequently, great damage has been caused to the public faith in the judiciary," it added.
The letter notes that while the High Court is facing "so many problems," namely a judge shortage that has resulted in fresh cases not being heard for months, "diminishing the public's faith in the rule of law," this "does not mean that we are trashing bin."
In an emergency meeting on Thursday, the Supreme Court Collegium agreed to move Justice Yashwant Varma from the Delhi High Court back to Allahabad.
