The Central Bureau of Investigation (CBI) informed the Calcutta High Court on Friday that the woman junior doctor from RG Kar Medical College and Hospital in Kolkata was not gang-raped. The court was hearing the case concerning her rape and murder, which took place in August last year.
Justice Tirthankar Ghosh, presiding over the single-judge Bench, directed the CBI to submit the original case diary prepared by the Kolkata Police. Additionally, the agency was asked to present a list of individuals interviewed in the case at the next hearing, scheduled for April 23.
During the hearing, Deputy Solicitor General Rajdeep Majumdar, representing the CBI, clarified that the crime did not fall under Section 70 (gang rape) of Bharatiya Nyaya Sanhita (BNS).
He stated that forensic tests had been conducted on all DNA samples from the crime scene and that a 14-member medical board, comprising doctors from various hospitals across the country, had reviewed the evidence. The investigation revealed no forensic proof of gang rape and DNA profiling was performed only on the convicted accused, Sanjay Roy.
When asked about the current focus of the probe, Majumdar said the agency was investigating whether there was a larger conspiracy behind the crime and whether there had been attempts to destroy evidence. The CBI was also looking into the role of hospital staff and officials in handling the case and whether any effort was made to cover up crucial evidence.
The prime accused, Sanjay Roy, has been convicted and sentenced to life imprisonment until the end of his natural life by the Sealdah Sessions Court for the rape and murder of the doctor. However, the CBI has filed an appeal seeking an enhancement of his sentence, which is currently pending before a division bench of the high court.
When questioned about the timeline for concluding the probe, Majumdar stated that the CBI could not commit to a specific timeframe at this stage.
