In a significant ruling on dearness allowance (DA), the Supreme Court has held that DA is not an additional benefit but a legally enforceable right meant to ensure a minimum standard of living for government employees.
Upholding the entitlement of West Bengal state government employees to receive DA, the apex court directed the state government to pay dearness allowance arrears for the period from 2008 to 2019. The court ordered that 25 per cent of the due DA be paid to employees by March 6.
A bench comprising Justices Sanjay Karol and Prashant Kumar Mishra delivered the verdict on Thursday while dismissing a petition filed by the West Bengal government challenging an earlier order on DA.
The Supreme Court ruled that once dearness allowance is defined under statutory rules by linking it to the All India Consumer Price Index (AICPI), the state cannot later alter the method of its calculation through an office memorandum. The court said such a right cannot be diluted by executive instructions.
The bench clarified that state government employees are entitled to receive DA arrears for the 2008-2019 period in accordance with the judgment. However, it also noted that employees are not entitled to claim DA twice in a year.
Explaining the importance of DA, the court observed that dearness allowance acts as a safeguard provided by a welfare state to protect employees from the impact of rising prices. “DA is not an additional benefit but a means of maintaining a minimum standard of living,” the court said.
Taking note of the financial implications of the ruling, the Supreme Court constituted a committee to determine the total payable amount and the payment schedule. The committee will comprise retired Supreme Court judge Justice Indu Malhotra, retired High Court judges Justice Tarlok Singh Chauhan and Justice Gautam Bhaduri, and the Comptroller and Auditor General of India (or a senior officer nominated by him).
The committee has been directed to finalise the payment amount and schedule, in consultation with state officials, before March 6, 2026. The first instalment is to be paid by March 31, as per the committee’s decision. The committee will also periodically verify the release of funds.
The court clarified that employees who retired during the 2008-2019 period are also eligible to receive the benefit. The West Bengal government has been directed to file a compliance report after making the first payment.

The matter will be heard again on April 15. Earlier, on May 16, 2025, the Supreme Court had passed an interim order directing the state government to pay 25 per cent of the due DA.
The judgment extensively dealt with the legal, constitutional, and practical aspects of dearness allowance and reaffirmed employees’ right to protection against inflation.
