Waqf Amendment Act SC Hearing LIVE: The Supreme Court will today resume the hearing of pleas challenging the constitutional validity of the recently enacted Waqf (Amendment) Act, 2025. The hearing will resume at around 2 pm today, with the top court expected to announce its verdict in the case. During the hearing on Wednesday, the Supreme Court proposed to put an interim stay on three provisions of the Waqf Amendment Act including the provision to include non-Muslims in the Waqf Boards and Waqf Councils.

Apart from this, the top court also raised concerns over two other aspects of the new legislation including the status of "waqf by user" properties previously recognised by courts, and the powers of collectors on deciding dispute over Waqf properties. A bench of Chief Justice Sanjiv Khanna and Justices Sanjay Kumar and V Viswanathan said that it is considering to pass an interim order to "balance equities". However, it agreed to give more time to Centre and States to present their case today.

    Appearing for the Centre, Solicitor General Tushar Mehta, today asked the court whether it is considering putting a stay on several provisions of the Waqf Act directly or indirectly. "I want to say something with respect and concern. This court is considering stay directly or indirectly which is rare," he said.

    The top court also said, "All Members of the Waqf boards and central Waqf Council must be Muslims, except the ex-officio members." The CJI further proposed to pass an order to say that ex-officio members could be appointed regardless of their faith but others had to be Muslims.
