The Supreme Court has strongly rebuked an Allahabad High Court judge over his ‘insensitive’ and ‘inhuman’ remark while dealing with the sexual harassment of a minor in Uttar Pradesh. The top court stayed Justice Ram Manohar Narayan Mishra's decision, which stated that acts like ‘grabbing breasts’ or ‘breaking the string of a pyjama’ do not tantamount to an attempt to rape. Besides, the SC has sought responses from the central and Uttar Pradesh governments regarding the matter.

“It’s very serious and exhibits a complete lack of sensitivity on the part of the judge… We are sorry to use such harsh words against a constitutional court judge, but this is one of those cases,” the top court stated.

A bench of Justices BR Gavai and Augustine George Masih expressed their disappointment, stating that some comments in the judgment were troubling. 

“We take strong exception to paragraphs 21, 22, and 26 of the judgment, which depict a total lack of sensitivity on the part of the author of the judgment. It is also not that the judgment was delivered on the spur of the moment—it was reserved in November and delivered four months later. It is thus clear that the judge applied his mind and authored this judgment,” the bench added.

Who Is Justice Ram Manohar Narayan Mishra?

Justice Ram Manohar Mishra was born on November 6, 1964. He began his academic journey by earning his law degree in 1985, followed by a post-graduate qualification in law in 1987. With a strong foundation in legal studies, he joined the Uttar Pradesh Judicial Service in 1990, starting his career as a Munsif.

Justice Mishra was promoted to the Higher Judicial Service in 2005. He held key positions in various districts, serving as District and Sessions Judge in Baghpat and Aligarh. He also served as the Director of the Judicial Training and Research Institute (JTRI). His service also included a tenure as District and Sessions Judge in Lucknow.

On August 15, 2022, Justice Mishra was elevated to the Allahabad High Court as an Additional Judge. He was sworn in as a Permanent Judge of the High Court on September 25, 2023.

In the ongoing Krishna Janmabhoomi-Shahi Idgah Mosque dispute in Mathura, hearings are being conducted by a bench led by Justice Ram Manohar Mishra. The next hearing in the case has been scheduled for April 3.
