The Delhi High Court has passed a significant judgment on the right of Central Armed Police Forces (CAPF) officers to choose their place of posting based on a relative's poor health.
A bench of Justice C Hari Shankar and Justice OP Shukla stated that no provision in the current CAPF policy allows an officer to choose their posting location based on their parents' ill health, but only if an officer's spouse or child is unwell.

While acknowledging that the provision may seem harsh, the court noted that allowing officers to select postings based on their parents’ health could hinder effective deployment.
However, the bench directed CAPF authorities to consider the officer’s request for posting at a location with adequate medical facilities for his father. If the request cannot be accommodated, the CAPF must provide a detailed explanation within a week, after which the officer must comply with the transfer order.

The observation came while hearing a petition from an officer who is the sole caregiver of his 90-year-old father and sought a transfer due to insufficient hospital facilities at his current posting.
