Cash-At-Home Row: Justice Yashwant Varma of the Allahabad High Court had been facing inquiry proceedings in the Lok Sabha after a huge stash of cash was recovered from his home last year. He had also accepted the initiation of impeachment proceedings for his removal if proven guilty.
However, following his resignation, the process is expected to come to an end, sources in the Lok Sabha Secretariat told NDTV.
Will Justice Yashwant Varma Get Retirement Benefits?
According to legal experts, if Justice Varma's resignation is accepted, he would be entitled to a pension and other benefits that a High Court judge gets upon retirement. This is in contrast to a parliamentary removal, under which he would have been deprived of such benefits.
Speaking to NDTV, Supreme Court Advocate on Record Akanksha Rai said several High Courts in the country have interpreted the resignation of a High Court judge as equivalent to retirement under the High Court Judges (Salaries and Conditions of Services) Act, 1954.
On this basis, a judge who resigns is entitled to the same pensionary benefits as those who superannuate, Rai said. "The same has been affirmed by the Supreme Court," Rai added.
Justice Varma Resigns On Day He Was To Begin His Defence Arguments
Justice Varma's resignation came on the day he was scheduled to begin he was to begin his defence arguments before the inquiry panel in connection with the corruption charges, sources said. He had been given time between April 10 and April 14 to submit his side of the case, they added, while the prosecution had already placed its arguments before the panel in March.
The judge came under scrutiny after a huge stash of cash was recovered from his home last year, when he was serving as a judge at the Delhi High Court. The cash was reportedly recovered from a storeroom near the servants' quarters. Justice Varma denied any involvement, stating that neither he nor his family had ever stored cash at the premises.
Following the discovery, the Supreme Court took away judicial work from Justice Varma at the Delhi High Court, transferred him back to his parent Allahabad High Court, and directed the Chief Justice not to assign him any judicial responsibilities.
