It seems that Indian expansion plans for Anthropic have hit a surprise legal roadblock. The San Francisco AI firm is being challenged by an Indian company of the same name, Anthropic Software, which claims that there is potential for brand confusion. Still pending in Indian court, the case could complicate Anthropic’s strategy in the country as the local company seeks to have its prior use recognised and to secure financial compensation for damages.

Anthropic Faces Legal Complaint in India

According to a report by TechCrunch, Anthropic Software filed a complaint last month in a commercial court in Karnataka. The Indian company has alleged that it has been using the Anthropic name since 2017 and claims that Anthropic’s entry into the Indian market has caused confusion among its customers.

The local firm is reportedly seeking recognition of its prior use of the Anthropic name and relief to prevent further confusion. It is also said to be demanding Rs. 1 crore in damages.

What the Indian Company Is Arguing

Anthropic Software founder and director Mohammad Ayyaz Mulla told TechCrunch that the intent behind the complaint is not confrontation but acknowledgement of prior use. He reportedly said that if recognition is not granted, the company may pursue litigation to resolve the matter.

Gadgets 360 staff members noted that the Indian company’s website states, “Anthropic is a trademark of Anthropic Softwares Pvt Ltd (Application Pending).” Since the trademark is still pending, the case may not automatically qualify as a trademark violation. However, if the court rules in favour of the Indian firm, Anthropic could be forced to consider a name change for its India operations.

Current Status of the Case

As per the report, Anthropic India was summoned by the court on January 20, but no interim injunction was granted. This means Anthropic is not required to halt its operations immediately. Another hearing is reportedly scheduled for February 16.

Separate Executive Exit

In a separate development, Anthropic’s AI safety lead, Mrinak Sharma, announced his departure this week in a post on X. He said he is not pursuing another venture immediately and plans to take a short break before deciding his next move.
