For many skilled professionals and entrepreneurs, working in the United States is a dream. However, most work visas require employer sponsorship, making it challenging for individuals without a job offer. The good news? There are specific visa categories that allow you to move to the US without needing an employer to sponsor you.
Two of the best options are the EB-2 National Interest Waiver (NIW) and EB-1A Extraordinary Ability Visa—both of which let you self-petition for a US work visa without a job offer. These visas are designed for highly skilled individuals who can prove their expertise and demonstrate their value to the country.
In this article, we’ll explore these visa categories, their eligibility requirements, and how you can apply to work and live in the US without employer sponsorship. Let’s dive in!
EB-2 National Interest Waiver (NIW)
The EB-2 NIW is an employment-based visa that allows applicants to apply for permanent residency (Green Card) without needing a job offer or employer sponsorship. To qualify for the EB-2 NIW, you must meet one of the following criteria:
Hold an advanced degree (master’s or higher) or a bachelor’s degree with at least five years of progressive work experience in your field.
Demonstrate exceptional ability in the sciences, arts, or business by meeting at least three of the following criteria:
Academic records proving a relevant degree or certification.
A license or certification to practice in your field.
Letters from employers documenting at least 10 years of experience.
Membership in professional organisations.
Proof of recognition for achievements from peers, government agencies, or professional organisations.
Evidence of a high salary or compensation demonstrating exceptional ability.
In addition, applicants must prove that their work has substantial merit and national importance, that they are well-positioned to advance their proposed endeavor, and that it is beneficial for the US to waive the standard job offer and labor certification requirement.
If approved, the applicant receives an EB-2 immigrant visa and a Green Card, allowing them to live and work permanently in the US. Their spouse and children under 21 can also apply for permanent residency.
EB-1A Extraordinary Ability Visa
The EB-1A visa is designed for individuals with extraordinary abilities in fields such as the arts, sciences, education, business, or athletics. Unlike the EB-2 NIW, the EB-1A has a higher eligibility threshold but provides a faster pathway to a Green Card.
If approved, EB-1A visa holders receive a Green Card without needing a job offer. Their spouse and children under 21 may also apply for permanent residency.
Both the EB-2 NIW and EB-1A visas provide unique opportunities for highly skilled individuals to work in the US. without employer sponsorship. While the EB-2 NIW focuses on individuals whose work benefits the national interest, the EB-1A is tailored for those with extraordinary achievements. If you qualify for either of these visas, self-petitioning can be a viable route to permanent residency in the US.
