Right To Appear In Exams Is Part of Fundamental Right To Live With Dignity: The Allahabad High Court has ruled that the right to appear in exams is linked to the Constitutional Right to live with dignity under Article 21. The court issued the ruling while considering a writ petition from a college student who was unable to participate in her semester exam. It further instructed Rajju Bhaiya University to organize a special examination for the petitioner within two weeks, permitting her to sit for the first semester BSc Biology paper for the 2025–26 academic year.

What Did Justice Vivek Saran Say?

The Court asked the respective university to announce the results within the stipulated time frame, so that the student can continue her education without any hindrance. 

"Appearing in examination is akin to right to live with human dignity enshrined in Article 21 of the Constitution and when the petitioner is not at fault, her future should not be jeopardized only on the technical lapses," the Court's January 12 order said.

What Was the Petition?

The petitioner was pursuing the BSc (Biology) program at the college. However, the university failed to provide her with the admit card during the first semester. This effectively stopped her from taking the semester exams. Feeling distraught, the petitioner filed a representation on November 27, 2025, to the Vice-Chancellor of the University via the Principal of the College. 

While the petitioner’s application and details were present on the University portal, they remained in "draft" status and were never officially processed, which resulted in the failure to issue the admit card.

Feeling helpless about the situation, the petitioner went to the High Court seeking redress.
