A bench comprising Justices Sanjiv Khanna, Dipankar Datta, and Prasanna B Varale ordered Singh's release on bail during the pendency of the trial.
Earlier in the day, the court had asked Additional Solicitor General SV Raju to ascertain whether Singh's further custody was necessary. ASG Raju, in the afternoon session, informed the court that although the ED had an arguable case, it was prepared to concede, allowing Singh to be released on bail.

SC also said that terms and conditions for AAP leader Sanjay Singh's bail in the money laundering case will be fixed by the trial court.
Singh was arrested by the Enforcement Directorate on October 4, 2023, in connection with the money laundering case related to the framing and implementation of the now-scrapped Delhi Excise Policy. The policy was allegedly aimed at benefiting certain liquor manufacturers, wholesalers, and retailers.
The case against Singh and other AAP leaders stems from a 2022 complaint filed by Delhi's Lieutenant General, VK Saxena, alleging irregularities in the framing of the Delhi Excise Policy for 2021-22.
Delhi Chief Minister Arvind Kejriwal and Bharat Rashtra Samithi leader K Kavitha were recently arrested in connection with the same case. Additionally, AAP leaders Manish Sisodia and Vijay Nair, who served as the party's communications in-charge, have also been arrested by the ED and are currently in judicial custody at Tihar jail.
