Bano has challenged the remission of sentences for 11 convicts in the case. A bench of Justices K M Joseph and B V Nagarathna said there is a gamut of issues involved and they need to be heard in detail.
The apex court has issued a notice to the Centre, Gujarat government, and also to the convicts in the case. It has directed the Gujarat government to be prepared with the files granting remission to the parties on the next day of the hearing. The bench said during the hearing that it would not be overwhelmed by emotions and would only go by the law.
Earlier on January 4, a bench comprised of Ajay Rastogi and Bela M Trivedi took up the petition filed by Bano and other pleas. However, Justice Trivedi recused herself from hearing the case without citing any reason.
Bano had moved to the top court on November 30 last year, challenging the premature release of the convicts by the state government.
