In a major development in West Bengal politics, the Calcutta High Court on Thursday cancelled the membership of senior Trinamool Congress (TMC) leader Mukul Roy in the West Bengal assembly under the anti-defection law.

Roy was facing legal scrutiny after he won the Assembly election and entered the House on a BJP ticket in May 2021, but joined the ruling TMC in August that year in the presence of Chief Minister Mamata Banerjee and TMC national general secretary Abhishek Banerjee.

While hearing the petition filed by the Leader of Opposition Bengal Assembly, Suvendu Adhikari, and BJP MLA Ambika Roy a division bench presided by Justice Debangsu Basak disqualified Roy as a member of the state assembly.

Adhikari had filed the petition before the high court, challenging Assembly Speaker Biman Banerjee's decision rejecting his plea to disqualify Roy under the anti-defection law, alleging that he switched over to the ruling TMC after being elected on a BJP ticket.

In May 2021, Roy had clinched the Krishnanagar North seat on the BJP ticket. While the high court cancelled the membership of Roy from the Assembly, it also rejected the decision of Assembly Speaker Biman Banerjee that Roy was a BJP MLA.

TMC fallout and rejoining

Roy was initially with the TMC but turned to the BJP in 2017 after two years of disagreements following his name came up in the Saradha scam as well as in the Narada sting operation.

He was suspended for six years by TMC after he met BJP leaders, including then Finance Minister Arun Jaitley and Kailash Vijayvargiya.

He later joined the BJP on September 25, 2017. On June 11, 2021, he rejoined the TMC along with his son Subhranshu Roy in the presence of CM Mamata Banerjee.

On June 25, 2021, he was inducted as a member of PAC by the Bengal Assembly Speaker.
