Former Madhya Pradesh High Court judge Justice Rohit Arya on Saturday joined the Bharatiya Janata Party (BJP) in the presence of Madhya Pradesh Deputy Chief Minister Rajendra Shukla.  Arya came to the limelight for denying bail to comedians Munawar Faruqui and Nalin Yadav after they were jailed in 2021 on a complaint of outraging religious sentiments during a comedy show in Indore. 

During a party event on the implementation of the new Bharatiya Nyay Sanhita (BNS), a new criminal law replacing the Indian Penal Code, Arya, who was inducted into the party by state BJP chief Dr Raghvendra Sharma said, "Prime Minister Narendra Modi has achieved a big task by replacing the IPC with BNS."

“We are grateful to the Central government for this. This will improve lives in the coming times as the Penal Code was imposed on Indians during British rule and implemented to punish them. The spirit of justice existed in our country during the Ram Rajya and Mahabharata era as well,” Justice Arya said, as quoted by the Indian Express.

Notably, Justice Rohit Arya, who began his legal career in 1984 was designated as senior advocate on August 26, 2003 by the Madhya Pradesh High Court. He had retired three months earlier and served in the judiciary for more than a decade. He is known for his various verdicts during his tenure as a judge. 

Earlier in 2021, Arya denied bail to stand-up comedians Munawar Faruqui and Nalin Yadav who were accused of hurting religious sentiments and violating Covid-19 protocols during a show in Indore. 

In another case, which received massive criticism, Arya granted bail to a man accused of outraging a woman's modesty on the condition that he present himself to the complainant on the day of Raksha Bandhan and get a rakhi tied on his wrist. He also directed the accused to promise that he would ‘protect’ the complainant.
