Gig workers will now have to be engaged for a minimum of 90 days with an aggregator in a financial year, or 120 days in case of working with multiple aggregators, to qualify for social security benefits, according to the draft rules released by the Union labour ministry for public consultation.
The proposed framework, formulated under the new Social Security Code, aims to extend formal social security coverage to gig and platform workers. According to the Times of India, the eligibility period has been fixed at 90 days with a single aggregator, while those associated with more than one platform must complete at least 120 days of engagement in a financial year to avail the benefits.
Draft Rules Include
1. Gig and platform workers must complete at least 90 days of engagement with an aggregator in a financial year to qualify for central social security benefits; this requirement rises to 120 days for those working with multiple aggregators.
2. A worker is considered “engaged” on any calendar day in which they earn any amount of income from an aggregator, irrespective of how small the payment is.
3. If a worker is associated with more than one aggregator, the total number of engagement days will be calculated cumulatively across all such aggregators.
4. If a worker is engaged with three different aggregators on the same day, it will be counted as three separate days of engagement for eligibility purposes.
5. Eligible gig and platform workers include those engaged directly by an aggregator or through associate, holding, subsidiary companies, LLPs, or even third-party entities.
Registration And Digital Identity For Unorganised Workers
1. All eligible unorganised workers must register on the Centre’s designated portal and will be issued a digital identity card containing their photograph and other government-specified details.
2. The e-Shram portal, already operational, functions as the national database to provide registered workers formal recognition and access to social security benefits.
3. Registered workers are required to regularly update personal and professional details, including address, occupation, mobile number, and skills.
4. Failure to keep these details updated may lead to loss of eligibility for social security schemes, as per the draft rules.
