Jagran Correspondent, Gurugram | The Gurugram district administration has initiated major action against 71 builders and promoters who have not paid the fines and refund amounts prescribed by the Haryana Real Estate Regulatory Authority (RERA). The move aims to provide relief to buyers in Millennium City who have been waiting a long time for their refund.
According to officials, a total of Rs 446 crore in recovery certificates are pending against these defaulting builders, with many cases remaining unresolved for more than four years.

Bank Accounts Of 71 Defaulting Builders Set To Be Frozen
The amount determined by the authority can be recovered as arrears of land revenue under Section 40(1) of the RERA Act, 2016. The district administration ordered the immediate freezing of the bank accounts of all 71 defaulter builders. The process of confiscating their movable and immovable properties has also been initiated under the provisions of the Punjab Land Revenue Act, as applicable in Haryana as well.

Speaking about the crackdown on defaulting builders, Gurugram DC Uttam Singh said that while it is appropriate for authorities to take punitive action against builders, the purpose of the entire process is defeated unless the recovered funds reach the actual beneficiaries - the home buyers.

The Deputy Commissioner asserted that the district administration will ensure that the funds legally due to home buyers are effectively recovered. The recovery process for HRERA dues in the district had not progressed at the expected pace in the past, Singh said, adding that the current action was initiated after a comprehensive review of all pending recovery certificates.
Non-Payment Of Refund May Lead To Arrest Of Builder
The Land Revenue Act says if the outstanding amount cannot be recovered from the frozen bank accounts or the attached properties, other coercive actions can be taken, including arrest and detention of the defaulters. Notices have been issued to all concerned builders to immediately deposit the outstanding amount.
Action Against These Defaulting Builders
Among the major defaulting builders, Ansal Housing/Ansal Construction Housing has outstanding dues of Rs 91 crore, Raheja Rs 90 crore, Vatika Rs 80 crore, Parsvanath Rs 74 crore, Ramprastha Rs 57 crore, IREO Rs 24 crore and ILD Millennium Rs 8.59 crore.
