Congress MP and Lok Sabha LoP, Rahul Gandhi, on Tuesday gave a dissent note during a meeting of the Prime Minister Narendra Modi-led panel to decide the next director of the Central Bureau of Investigation (CBI).

Gandhi said, "I have written to the Prime Minister recording my dissent from the CBI Director selection process."

Labelling the selection process as a 'biased exercise', Gandhi said that the LoP is not a rubber stamp.

He said, "I cannot abdicate my constitutional duty by participating in a biased exercise; LoP is not a rubber stamp."

According to news agency PTI, Gandhi has also raised the issue of the alleged misuse of the federal probe agency by the government in his dissent note. Gandhi flagged the alleged misuse to target political opponents, journalists, and critics.

Gandhi also wrote that "LoP was included in the selection process to prevent institutional capture" but "regrettably", the government has "continued to deny me any meaningful role."

Alleging a denial by the government of 69 candidates, a deliberate attempt, Gandhi accused the Centre of making a mockery of the selection process and rendering it a mere formality.

"Cannot abdicate my constitutional duty by participating in this biased exercise; I dissent in the strongest terms," Gandhi wrote in his note to the PM.

How is CBI Director appointed? 

According to the rules, the decision on the CBI director is taken by a three-member panel headed by the prime minister. The other members in the panel include the Chief Justice of India and the Lok Sabha LoP. 

The term of the incumbent director, Praveen Sood, is scheduled to end on May 25, 2026. Sood's tenure was set to end in 2025. However, he got a one-year extension from the Centre till May 25.
