Drama continued to unfold over the Rs 3,000 crore estate of businessman Sunjay Kapur as the Delhi High Court resumed the hearing of the plea by the children of actor Karishma Kapoor. Senior advocate Mahesh Jethmalani, representing Samaira, 20, and Kiaan, 15, alleged that the will was forged as a means to disinherit the children from his first marriage.

Jethmalani questioned the authenticity of the will, calling that “something was very secretive about this will”. He argued that, “This ‘will’ does not involve Sunjay Kapur… and we were not supplied with any documents either.”

Pointing out several inconsistencies, he noted that the will even misspelled one son’s name and listed the daughter’s address incorrectly. “These bloopers (are) very uncharacteristic of Sunjay Kapur,” he remarked. “Sunjay Kapur was in great health and his Indian property was secured by a tight trust. The circumstantial evidence is so completely contrary it leads to assumptions… that the contents of the will are bad. I say this based on his phone conversations with his ‘disinherited’ children,” Jethmalani was quoted as saying by NDTV.

Emphasising Kapur’s close bond with his children, he questioned, “He had a very good relationship with his children. So how could he have written his daughter’s address wrong and misspelled his son’s name in multiple places?”

Samaira and Kiaan are Sunjay Kapur's children from his marriage with Karishma Kapur. The two wed in September 2003 and divorced in 2016, when she accused him of physical and mental abuse. He remarried model Priya Sachdev a year later and had a son, Azarias, with her.

What Is The Case?

The current case involves a plea for status quo in the execution of Sunjay Kpur’s will, the one presented by his second wife, Priya Sachdev Kapur. Samaira and Kiaan alleged that Priya has taken full control of Sunjay’s assets by forging a will after he died in the UK in June. According to the will presented by Priya, all the personal estates of Sunjay will be transferred to her. 

The will, dated March 21, was called an ‘ominously uncertified document’ by Jethmalani. He further argued in the court, "We have no idea what happened to the will. It was modified on March 17. It is not clear who modified it... but it was modified again on March 24."

When asked about an explanation for these dates, Priya Kapur’s lawyer, Senior Advocate Rajiv Nayar, said that the changed dates in the MS Word document were a consequence of the file upload process. "You can check... all of them are the same document," the counsel said.

Jethmalani countered Nayar’s statement, "There was a modification on March 24. They have not explained it. On March 21 the question of the will was over. Why a three-day delay? Now there are two 'wills'." The senior advocate further said that a secret WhatsApp group was created between Sunjay, Priya and Dinesh Agarwal, who is accused to be an accomplice of Priya in forging the will. The forged will sent as a .pdf file and its name was changed twice, claimed Jethmalani.

"Two wills were simultaneously prepared... the husband and wife. These were not mutual wills and so have to be explained," he argued while trying to pin the blame of ‘conspiracy’ on Priya.

Jethmalani Calls Priya ‘Greedy’

The trial had seen massive drama last week as well, with Priya Kapur being compared to Cinderella’s stepmother. Jethmalani did not hold back his list of accusations and even called her ‘greedy’. Jethmalani said that Priya already received 60 percent of the assets and allocated 12 percent to her son. Furthermore, he pointed out that she is set to receive 75 percent of the trust, yet she is reportedly only concerned with her personal assets.

Samaira and Kiaan are not the only ones staking their claims on the ‘disputed’ assets of Sunjay Kapur. Rani Kapur, Sunjay’s mother, has also reportedly challenged the will. In a public statement, Rani said that in the middle of this fiasco, nothing was left at her disposal.
