Nishikant Dubey's Remarks Against CJI: The Supreme Court on Tuesday agreed to hear a plea against BJP MP Nishikant Dubey's derogatory remarks about the top court and the Chief Justice of India (CJI) Sanjiv Khanna. A bench of Justices BR Gavai and Augustine George Masih agreed to take up the matter next week after a counsel mentioned it for urgent listing.
The counsel, who has already filed a plea in the top court, apprised the court that a video of BJP MP Nishikant Dubey is going viral on social media platforms. In the video, he can be heard saying that the CJI was responsible for "civil wars" in the country. The counsel further said that the video of his remarks has attracted derogatory remarks against the apex court on social media platforms.
He asked the court to direct social media platforms to remove the video. "This is a very serious issue. At least give directions today to the social media platforms to remove this video," he said. However, the court did not pass any order and listed the matter for next week.
The counsel further told the court that the government was not taking action against Dubey. He said that one of his colleagues, Anas Tanveer, wrote to Attorney General R Venkataramani seeking consent to initiate contempt proceedings against Dubey over his "grossly scandalous" remarks aimed at lowering the dignity of the top court, but no action had been taken to date.
Nishikant Dubey's Remarks On CJI:
BJP MP from Jharkhand's Godda, Nishikant Dubey, last week sparked a massive controversy with his remarks against the top court and the Chief Justice of India. Dubey said that Parliament and state assemblies should be shut if the apex court has to make laws. Taking a swipe at CJI Sanjiv Khanna, Dubey said that he is responsible for "civil wars" in the country.
Dubey's remarks came days after the Supreme Court proposed a stay on several provisions of the Waqf (Amendment) Act, including the inclusion of non-Muslims in Waqf Boards and Waqf Councils. The court also raised objections to the provision on de-notifying properties declared as waqf by courts in earlier rulings.
The Centre assured the court that it would not be implementing some of the contentious provisions of the Waqf (Amendment) Act till the next day of hearing, which has been scheduled for May 5.
BJP Distances Itself:
Meanwhile, the BJP distanced itself from Dubey's criticism of the Supreme Court, with party president J P Nadda calling the comments his personal views. He also affirmed the ruling party's respect for the judiciary as an inseparable part of democracy. Nadda said he had directed party leaders not to make such comments.
