Delhi Police added Section 201 against Bibhav Kumar for allegedly destroying evidence and providing false information in connection with the assault case of AAP MP Swati Maliwal, an official said on Monday. Bibhav Kumar, a close aide to Delhi’s Chief Minister Arvind Kejriwal, is accused of assaulting Swati Maliwal at CM Arvind Kejriwal’s official residence on May 13. Bibhav Kumar was arrested on May 18 and is currently lodged in Tihar Jail.
The initial FIR, filed on May 16, included charges such as those related to criminal intimidation, assault or criminal force on a woman with the intent to disrobe, and attempt to commit culpable homicide.
An official confirmed the addition of this section on Monday, which could lead to imprisonment of up to one-sixth of the term for the primary offence involved, reported news agency PTI.
Swati Maliwal, a former chief of the Delhi Commission for Women, claimed that Bibhav Kumar attacked her violently during a visit to meet CM Arvind Kejriwal. Maliwal, alleged in her complaint that Bibhav Kumar attacked her with full force, slapped and kicked her.
Police said investigations revealed that Kumar’s mobile phone was formatted, potentially to erase evidence, leading to his arrest on May 18. Despite being taken to Mumbai twice, where he is suspected of formatting his phone, Kumar has not cooperated with the police regarding the location or individuals involved in the data deletion.
Additionally, three CCTV DVRs from CM Kejriwal’s residence are under forensic examination for possible tampering, with reports pending. Bibhav Kumar, who was arrested on May 18, is currently detained in Tihar jail.
