Unnao Rape Case: Supreme Court Says 'Inclined To Stay Order' Of Kuldeep Sengar's Sentence

Unnao Rape Case: The Supreme Court has stayed the Delhi High Court's verdict to suspend the life sentence of former BJP MLA Kuldeep Singh Sengar in the Unnao rape case.In its plea, the central agency has stated that the high court did not declare Sengar a public servant while issuing the order, contradictory to a Supreme Court verdict. Apart from the agency's plea, the apex court will also hear a separate petition filed by advocates Anjale Patel and Pooja Shilpkar. Ahead of the key hearing, the victim has expressed her faith in the judiciary by stating that Sengar's bail is a threat to her family.

Unnao Rape Case: CBI Seeks Stay

While referring to the apex court's verdict in the LK Advani case, the CBI has stated that anyone holding a constitutional post must be deemed a public servant. The agency further stated that the High Court declared that Sengar, an MLA at the time when the offence was committed, was not a public servant.

"The high court failed to consider that a sitting MLA, by virtue of holding a constitutional office, is vested with public trust and authority over the electorate and that such a position carries heightened responsibility arising from duties owed to the state and society," the CBI stated in its plea. "It has erred in law by failing to adopt a purposive interpretation that advances the object and intent of the POCSO Act," it added.

Earlier on December 23, the Delhi High Court suspended Sengar's life sentence by stating that he has already served over five years in the prison. However, the victim has opposed the bail by stating that her family has faced several consequences due to the court's verdict.

"I have faith that I will get justice in the Supreme Court. Kuldeep Sengar has bribed a Delhi HC judge and a CBI investigating officer. My husband's job was snatched away; my children and witnesses are under threat," the victim stated.
