The Supreme Court on Monday warned the Election Commission of India (EC) to set aside the entire special intensive revision (SIR) exercise of Bihar in case of any illegality. The top court added that it assumes that, being the constitutional authority, the poll body was following the law.
A bench of Justices Surya Kant and Joymalya Bagchi set October 7 for hearing final arguments regarding the validity of the Bihar SIR and refused to offer any "any piecemeal opinion" on the exercise.
The apex court also asserted that its decision will apply to SIR across India. The bench said, "Our judgement in Bihar SIR will be applicable for Pan-India SIR".
Furthermore, it clarified that it can't stop the poll panel from conducting a similar exercise for the revision of the electoral rolls across the country.
However, the bench has allowed petitioners against the Bihar SIR to also argue on the pan-India exercise on October 7.
Meanwhile, the apex court issued notice on a plea seeking the recall of the September 8 top court order directing the poll panel to include the Aadhaar card as the 12th prescribed document in the Bihar SIR.
On September 8, the top court clarified that Aadhaar will not be considered the proof of citizenship and the poll body can ascertain its genuineness upon being submitted by an elector for inclusion in the electoral rolls.
The electoral roll revision exercise was conducted across Bihar. The enumeration phase started on June 24 and went on till July 25. The draft rolls were subsequently published on August 1.
The poll body then provided a one-month period, until September 1, for electors and political parties to add or remove names from the draft rolls. The poll body is set to release the final electoral rolls of Bihar on September 30.
