UGC 2026 Row Highlight: Supreme Court To Hear Plea Challenging 'Non-Inclusive' Equity Rules; CJI Agrees To Urgent Listing

The CPI(M) Politburo is urging the UGC to rectify shortcomings in the new Promotion of Equity Regulations, 2026. While they support the mandatory "equity committees" to address discrimination on campuses, they emphasise the need for strict monitoring for effective implementation.

These regulations stem from Article 14 and Supreme Court pronouncements, similar to the 2012 guidelines. Consequently, the CPI(M) demands that these regulations be implemented in letter and spirit to ensure true equality on campuses.

However, they highlight a "serious deficiency" as these regulations currently exclude IITs, IIMs, and AIIMS. The government must immediately extend these mechanisms to all central institutions.

According to sources, the government is expected to clarify its position on the concerns related to the new UGC regulations soon. Discussions are ongoing within the ministry, and all aspects of the issue are being thoroughly reviewed before an official response is issued.

On Wednesday, people from different communities in Pilibhit protested against the UGC (University Grants Commission) regulations and took to the streets demanding their withdrawal. The protesters gathered at Nakta Dana Chowk and then marched towards the district court complex.

During the march, many protesters wore black armbands and black marks on their foreheads, blew conch shells, and chanted slogans. Some protesters even shaved their heads as a symbol of protest. Upon reaching the court complex, a large number of lawyers also joined the demonstration.

A petition has been filed in the Supreme Court challenging the recently issued regulations of the University Grants Commission (UGC). The petition alleges that these regulations adopt a non-inclusive definition of caste-based discrimination and exclude certain categories from institutional protection. The UGC's decision to formulate new rules to prevent caste-based discrimination in colleges and universities has sparked widespread protests against the government across the country.

The petition states that the UGC's recently notified 'Regulations on Promoting Equality in Higher Education Institutions, Rule 3(c)' is non-inclusive and fails to protect students and faculty members who do not belong to reserved categories.

The petition, filed by Vineet Jindal, criticises the new rules, stating that caste-based discrimination has been narrowly defined as discrimination only against members of Scheduled Castes (SC), the Scheduled Tribes (ST), and Other Backward Classes (OBC).

Senior advocate Indira Jaisingh has defended the UGC 2026 regulations amid the ongoing controversy, saying the rules are firmly grounded in Article 15 of the Indian Constitution, which prohibits discrimination based on caste, religion, sex or place of residence.

 Tej Pratap Yadav, national president of the Janashakti Janata Dal, has expressed strong support for the UGC 2026 Promotion of Equity in Higher Education Institutions Regulations.

Sharing his views on social media, he said: "Under the Supreme Court’s directions, the UGC has taken a historic step for the benefit of students from poor, Dalit, backward, and extremely backward communities. Every university and college will now have an Equity Committee to ensure grievances of SC, ST, and OBC students are addressed promptly. This law strengthens equality and rights for all students and ensures constitutional protections."

Yadav added that some critics may not realize that Dalit, tribal, and backward communities also fall under the broader Sanatan society and that the law supports these groups as brothers and sisters of the same nation.

3. At the same time, Dalits and backward classes should also not be misled by the inflammatory statements of selfish and corrupt leaders from these communities, who engage in despicable politics under this pretext. People from these communities should remain vigilant; this is also an appeal.

During the student protest against the University Grants Commission (UGC) Bill 2026, student Anuj Tripathi said, "We strongly oppose this... People from all castes come here to study. If you look at it from only one perspective, if you believe that only the upper castes are oppressing others, then that's not true. If this UGC law is passed, our mutual affection will disappear because people will start fearing us. They will be afraid to sit or talk with us. We will also be afraid of them, thinking, 'What will we do if we sit with them and they inadvertently drag us into a controversy?' Everyone faces pressure from their families to cut ties with someone if they are misunderstood.

The UGC brought the regulations to address the issue of caste-based discrimination in university campuses. Petitions have been filed in the Supreme Court challenging Regulation 3(c) on the ground that the protection accorded by it against caste-discrimination is non-inclusionary.

As per Regulation 3(c) of the UGC Regulations, "caste-based discrimination" means "discrimination only based on caste or tribe against the members of the scheduled castes, scheduled tribes, and other backward classes".

The Supreme Court has agreed to hear a petition challenging the new regulations. The rules, which govern recruitment, have raised questions about the definition of caste-based discrimination in appointments. The case is likely to involve debate on several key panels related to higher education.

The newly notified Promotion of Equity in Higher Education Institutions Regulations, 2026, provides a comprehensive set of anti-discrimination rules for all colleges, universities, and higher education institutions.

The implementation of these regulations means that every higher education institution will be responsible for eliminating discrimination, promoting equality among stakeholders, and taking appropriate protective and preventive measures to eliminate discrimination against stakeholders and safeguard their interests without discrimination based on caste, creed, religion, language, race, gender, or disability.

General category students are protesting against the new student interview process. They allege that these rules are biased against them. The opposition claims that the rules discriminate against only SC, ST, and OBC students. General category students are not considered victims of discrimination, and this is being protested at all levels. Members of the general community say that any student could file a petition to implicate their peers to benefit from these provisions.

A petition has also been filed against this in the Supreme Court. The petition states that it is against the UGC Act and the spirit of equal opportunity in higher education. Those protesting say that this will not reduce discrimination, but rather increase it.

The UGC (University Grants Commission) provided data on caste-based discrimination to the Supreme Court in a report. According to the report, the number of recorded cases of caste-based discrimination in higher education institutions was 173 in 2017-18, which increased to 378 in 2023-24, representing a 118.4% increase in five years.

These figures are from the UGC's own data, which was submitted to a parliamentary committee and the Supreme Court. The number of reported cases increased from 18 in 2019-20 to 108 in 2023-24.

As per the new rules, every college/university must offer the following facilities:

1. Online Portal: Register complaints from home via the Grievance or Equal Opportunity Center (EOC) section on the college website.

2. 24×7 Equity Helpline: A special helpline number available around the clock for immediate assistance.

3. Email: Submit a formal email to the EOC, providing a written record.

4. Offline/Written: Deliver a written complaint directly to the EOC by visiting the college.

For those preferring anonymity, the college will keep their identity confidential upon request.

A plea has been submitted to the Supreme Court challenging the newly introduced UGC regulations. The petition was filed by Advocate Vineet Jindal.

It is worth noting that the new framework was introduced after directions from the Supreme Court. The petition prompting these directions was filed by the mothers of Rohith Vemula and Payal Tadvi, seeking stronger protections and accountability mechanisms within higher education institutions.

A discussion forum was held on the Lucknow University (LU) campus, where students debated the ongoing controversy surrounding the UGC's new guidelines for 2026. Students expressed mixed opinions, with some supporting the reforms while others raised concerns about their impact on equality and representation within the campus.

Meanwhile, at Patna University, the UGC guidelines sparked clear dissent among students. A significant number of students protested against the new rules, carrying placards and demonstrating within the campus. However, several students also expressed support for the regulations.

The UGC’s new regulations replace the 2012 anti-discrimination guidelines with a legally binding framework that broadly defines discrimination and mandates proactive steps to promote equity in higher education institutions.

The rules clearly outline institutional responsibilities, requiring colleges and universities to establish formal systems to prevent, address and monitor discrimination. Key changes include wider definitions of unfair treatment and an enforceable compliance mechanism, with penalties for institutions that fail to meet prescribed requirements.

The statement criticises the UGC guidelines, arguing that they worsen campus tensions by promoting further discrimination instead of effectively addressing existing discrimination.

Union Education Minister Dharmendra Pradhan has addressed concerns regarding the new UGC 2026 regulations, stating, “I assure everyone there will be no discrimination and no one can misuse the law.”

Students from several Delhi colleges staged a protest outside the UGC headquarters on Tuesday, warning that the newly issued regulations could create confusion and unrest on university campuses. They argued that the rules may negatively impact the academic environment.

The protesting group submitted a memorandum demanding a complete rollback of the regulations. PhD scholar Alokit Tripathi said UGC officials accepted their submission and agreed to discuss some of the listed concerns

Amid rising protests and mounting political pressure, the Central Government has responded for the first time to the controversy. Union Education Minister Dharmendra Pradhan stated clearly that the government does not support any form of discrimination. Assuring students and aspirants, he said strict measures will be taken to ensure that the law is not misused.

The new rules aim to promote fairness and inclusion in higher education. They focus on reducing caste-based discrimination and supporting students from marginalized communities such as Scheduled Castes (SC), Scheduled Tribes (ST), Other Backward Classes (OBC) And Economic Weaker Section (EWS).

1. Role of the University:

Every college or university must set up special bodies, like Equal Opportunity Centers and Equity Committees.

These bodies handle complaints of discrimination and monitor the campus environment for fairness.

Institutions are also expected to run awareness programs and provide support to affected students.

2. Role of the UGC:

Policy Oversight: UGC will make sure universities implement the regulations properly.

Support: It will provide academic and financial guidance to help disadvantaged groups succeed in higher education.

Coordination: UGC will coordinate with government authorities and civil society organizations to ensure smooth execution of these policies.

3. Additional Measures:

1. Helplines & Complaint Mechanisms: Students can report caste-based or other discrimination.

2. Monitoring & Reporting: UGC will track how universities implement these measures, ensuring accountability.

3. Prevent misuse: The regulations also talk about due process, although critics say the rules don’t yet explain fully how false complaints will be handled.
