In a move aimed at reducing property disputes, the Uttar Pradesh cabinet, chaired by Chief Minister Yogi Adityanath, has approved a major concession on stamp duty and registration fees for the division of joint family (ancestral) property.
Under the new rules, the maximum cost for a formal partition deed will be Rs 10,000, comprising Rs 5,000 as stamp duty and Rs 5,000 as registration fee. The benefit will apply immediately after the government order is issued.
Previously, a stamp duty of four per cent of the property value, along with a one per cent registration fee, was levied for partition deeds. The government noted that such high expenses discouraged families from executing partition deeds, often resulting in prolonged property disputes in civil and revenue courts.
Minister of State (Independent Charge) for Stamps and Registration, Ravindra Jaiswal, stated that the uniform fee will now apply to the division of property spanning up to four generations. He emphasised that this concession will encourage the registration of partition deeds, giving co-owners formal ownership over their respective shares and reducing disputes.
The government anticipates a revenue loss of approximately Rs 6.39 crore, with Rs 5.59 crore from stamp duty and Rs 80.68 lakh from registration fees. However, Jaiswal explained that in the long term, registered partition deeds will allow co-owners to sell their shares, ultimately increasing stamp revenue.

Jaiswal added that while revenue loss is a consideration, the primary benefit is relief to residents, as the move will significantly reduce family property disputes and legal complications. The concession aligns Uttar Pradesh with states like Tamil Nadu, Karnataka, Rajasthan, and Madhya Pradesh, which have implemented similar measures.
