Uttarakhand UCC: Govt May Relax Live-In Relationship Registration Rules

The Uttarakhand government is preparing to relax the registration of live-in relationships under the Uniform Civil Code to ensure the right to privacy is not violated. The Home Department has submitted an affidavit to the court, according to which changes may be made to the marriage registration rules. Couples entering a live-in relationship may be granted an exemption from providing certain information, and other regulations are also likely to be amended.

Uttarakhand UCC: Govt May Relax Live-In Relationship Registration Rules

The state government is preparing to ease the information requirements for registering live-in relationships under the recently implemented Uniform Civil Code (UCC). This move comes in response to court challenges arguing that certain provisions violate the fundamental right to privacy. The Home Department has submitted an affidavit to the court outlining its intention to relax these rules.

Changes may also be considered for marriage registration regulations, with the primary focus across amendments being the protection of the right to privacy.

The UCC, now in effect in the state, includes mandatory provisions for the registration of both marriages and live-in relationships. Following its implementation, several individuals approached the court specifically regarding the live-in relationship rules.

Based on the government's affidavit and ongoing review, the following relaxations are being considered for live-in relationship registrations:

- Couples may be exempted from the requirement to disclose details of previous divorces or other past live-in relationships.

- The mandatory rule to report a pregnancy or birth occurring after the relationship ends could be removed.

- The provision allowing for investigation into other relationships is likely to be scrapped.

- The rule requiring the informing of parents when adults enter a live-in relationship may be amended.

- The mandatory requirement of providing an Aadhaar card could potentially be relaxed.

Home Secretary Shailesh Bagauli confirmed the government's stance, stating, "Efforts are being made to ensure that the existing rules do not conflict with the right to privacy." He added that preparations to amend the regulations are currently underway on this basis.
