In a significant ruling, the Bombay High Court has upheld a family court's order directing a man to pay Rs 15,000 monthly alimony to his divorced wife. A bench of Justice Manjusha Deshpande delivered the verdict on June 18, dismissing the man's plea challenging the family court's decision.
The man had argued that his wife, earning Rs 25,000 per month, didn't need alimony, citing his own salary of Rs 1 lakh per month as insufficient to support her. He also claimed responsibility for his ailing parents. However, the High Court rejected these arguments.
The court observed that despite the wife's income, it was insufficient for her maintenance, considering her daily commute and living arrangements with her parents and brother. The court noted that the husband's earnings far exceeded his wife's, and his father's pension of Rs 28,000 indicated that his parents weren't dependent on him.
Given these circumstances, the High Court upheld the family court's order, directing the man to pay Rs 15,000 monthly alimony to his wife. The petition was subsequently dismissed.
Earlier, the Delhi High Court, in May this year, pronounced that a woman who quit her job to care for her child as a single parent was entitled to alimony since it was not a deliberate abandonment of employment. In a ruling on May 13, Justice Swarana Kanta Sharma stated that the situation can be seen as the consequence of the primary responsibility to care for the child.
