The Allahabad High Court on Friday pulled up the Uttar Pradesh police for allegedly pressurising judges. Justice Arun Kumar Singh Deshwal, while addressing Director General of Police (DGP) Rajiv Krishna and Additional Chief Secretary (Home) Sanjay Prasad during a hearing, made a strong observation on the police, saying it could not allow UP to become a 'police state'.
The court was hearing a matter related to rising police encounters in UP. The top officers attended the hearing after they were asked to appear via video conference to explain what the authorities have done so far to curb the growing trend of police shooting accused in their legs.
Justice Deshwal said police officers in Uttar Pradesh are regularly pressurising judges, particularly chief judicial magistrates, to pass specific orders.
"Dekhiye isko na police State nai banane dena (See, can’t allow this to become a police state)," he said, expressing disappointment.
Each and every district, law is not being followed, the court pointed out, adding that he had not come across a single case where law or direction of the apex court had been followed.
"Whenever the judicial officer or CJM asks why they don’t comply, then a tussle starts between the Superintendent of Police and judicial officer. This has become a routine feature that the SP starts pressurising the judicial officer for a particular order," Barand Bench reported, quoting Justice Deshwal.
Allahabad HC Seeks Relevant Security Rules For Retired HC Judges
Earlier, on January 22, the Allahabad High Court sought from the Uttar Pradesh government relevant security rules, if any, framed for retired high court judges. The order was passed by a bench comprising Justice Ajit Kumar and Justice Swarupama Chaturvedi hearing a petition filed by the Association of Retired Supreme Court and HC Judges.
During the course of the hearing, the advocate of the association argued that the security of retired judges is a serious issue and needs to be addressed.
"Minimum security even a retired judge needs to have while he moves out in public. A constitutional post holder at least deserves this much protection to his life and his family after he demits office," added petitioners' counsels.
