The US Citizenship and Immigration Services (USCIS) has introduced key modifications aimed at improving transparency, streamlining the application process, and ensuring a fairer selection system. Among the most notable updates are a substantial increase in registration fees and a ban on multiple filings for the same candidate by different employers. Additionally, the entire process will now be conducted online, reducing paperwork and expediting processing times. These reforms are expected to impact both employers and foreign workers, making H-1B sponsorships more selective and efficient. Here's everything you need to know about the latest changes.
The updated system is designed to improve transparency, efficiency, and fairness in selecting foreign workers.
Key Changes to the H-1B Registration Process
Mandatory Online Registration
The entire application process will now be conducted online. This shift is expected to streamline operations, reduce paperwork, and accelerate processing times by eliminating delays associated with paper-based applications.
Increased Registration Fees
The fee for submitting an H-1B entry has surged from $10 to $215. This sharp increase is intended to make businesses more selective when sponsoring foreign workers.
Who Will Be Affected?
The changes will impact all temporary labor condition applications, including:
H-1B & H-1B1 visas (for specialty occupations)
H-2A & H-2B visas (for agricultural and non-agricultural temporary workers)
E-3 visas (for Australian professionals)
PERM applications (for employment-based green cards)
Objectives of the New System
Preventing System Manipulation: The revised system ensures a fairer selection process by preventing large firms from submitting multiple applications for the same candidate to increase their chances of selection.
Encouraging Selective Sponsorship: Higher fees may discourage frivolous applications, ensuring only serious employers participate in the program.
Expediting Processing Times: Digitisation will reduce administrative backlogs and speed up processing.
Record Deletion & Employer Action Required
According to the Financial Times, any records older than five years will be deleted from the Foreign Labor Application Gateway (FLAG) system. Employers are advised to:
Download and back up all records before March 20.
Log into their USCIS online accounts to retrieve registration confirmations, petition receipts, and correspondence.
Ensure fees are paid correctly, as late or incorrect payments could result in application rejection.
Ensuring Compliance with the New System
Applicants who registered between March 7 and March 24, 2025, must confirm that the USD 215 fee (or any updated amount) has been paid. Employers should verify their USCIS accounts for any outstanding payments linked to FY 2025 or 2026 registrations.
With these changes, the USCIS aims to create a more transparent and efficient H-1B selection process, benefiting both employers and skilled foreign workers.
