An Indian national has been awarded nearly 67,000 Pounds (around Rs 81 lakh) in compensation by a UK employment tribunal after it ruled that he was wrongfully dismissed and subjected to racial discrimination at a KFC franchise outlet in south-east London.

Madhesh Ravichandran, a resident of Tamil Nadu, had approached the tribunal alleging sustained racial abuse and unfair treatment by his manager at the West Wickham KFC outlet where he worked in 2023. The tribunal upheld his claims, describing the discrimination as “well-founded” and backed by evidence.

Tribunal Finds Case Of Race Discrimination

According to details from the hearing published this week, tribunal judge Paul Abbott ruled that Ravichandran was treated less favourably because of his nationality. The judgment noted that his holiday requests were denied while preference was given to Sri Lankan Tamil colleagues and that he was subjected to deeply offensive racial slurs.

The tribunal recorded that the manager used derogatory references such as “slave” and made remarks including “Indians are fraudsters,” conduct which the judge said was self-evidently discriminatory and degrading. “This racial abuse from a manager had the purpose and the effect of violating the claimant’s dignity,” the judgment stated, adding that such behaviour amounted to direct race discrimination under UK employment law.

Dispute Escalated Over Excessive Work Hours

Ravichandran had joined the KFC outlet in January 2023 and reported directly to the restaurant manager. The tribunal heard that tensions escalated over the following months, culminating in July when he was allegedly pressured to work excessive hours during a shift.

Judge Abbott accepted Ravichandran’s account that his decision to resign was a direct result of persistent attempts by the manager to make him work unreasonable hours. During follow-up calls after he handed in his notice, the manager allegedly became racially abusive and threatening.

The tribunal concluded that Ravichandran was “summarily dismissed” while serving his notice period and was denied his statutory right to one week’s notice pay.

Compensation And Mandatory Training Ordered

As part of the remedy, the tribunal awarded Ravichandran £62,690 in compensation. Additional payments towards holiday pay and employment-related entitlements brought the total to approximately £66,800.

The ruling also directed Nexus Foods Limited, the company operating the KFC franchise, to introduce a mandatory workplace discrimination training programme for all staff. The programme must include specific guidance for managers on handling grievances related to discrimination and is to be implemented within six months.

The case highlights the UK’s strict stance on workplace equality and reinforces legal protections against racial discrimination, particularly within the service and hospitality sector, which employs a large migrant workforce.
