The US Department of Justice has taken note of allegations that an American IT staffing firm may have discriminated against US citizens by advertising jobs exclusively for H-1B visa holders, triggering a wider debate over hiring practices in the tech sector. 

The controversy began after former West Virginia State Delegate Derrick Evans highlighted a report by The Washington Free Beacon on social media platform X. The report, titled “‘No US Citizens’: Meet the IT Firms Discriminating Against Americans,” named LanceSoft, an IT staffing and recruitment firm based in Herndon, Virginia, as one of the companies under scrutiny.

‘No USC/GC’ Line Sparks Outrage'

According to the report, a job advertisement posted by LanceSoft showed language that appeared to exclude American citizens and green card holders. The listing, reportedly shared on November 25 by recruiter Riyaz Ansari, advertised a USD 60-per-hour role in Santa Clara, California, and included the line: “No USC/GC for this role,” referring to US citizens and lawful permanent residents.

Assistant Attorney General for Civil Rights at the US Department of Justice, Harmeet Dhillon, responded publicly to the allegations, saying the issue would be examined and that her office was working with other federal agencies to address potential discrimination.

DOJ And Labour Department Step Up Enforcement

Dhillon said the Justice Department takes seriously any practices that may violate the Immigration and Nationality Act. The US Department of Labor has also stepped up enforcement, with more than 175 investigations opened into potential misuse of the H-1B visa programme. 

Reporter Aaron Sibarium, who authored the report, said the job posting explicitly targeted H-1B visa holders while discouraging US citizens and green card holders from applying, language that legal experts say could expose firms to significant legal consequences.
