The Delhi High Court has stayed clean energy agency SECI's decision that barred Anil Ambani group firm Reliance Power Ltd from participating in auctions for three years, the company said on Tuesday. Earlier this month, the Solar Energy Corporation of India (SECI) barred Reliance Power and its units from participating in auctions for three years over allegations of submitting a fake bank guarantee to support its bid for a recent battery storage tender.

Reliance NU BESS had submitted a bank guarantee allegedly issued by FirstRand Bank through its branch located in Manila City, Manila, Philippines. After a detailed investigation, the Indian branch of the aforementioned bank confirmed that no such branch of the bank exists in the Philippines, leading SECI to conclude that the submitted BG was a fake document.

"High Court of Delhi, in its hearing held today, has granted a stay on notice of debarment and public notice issued by SECI against the company, including all its subsidiaries except Reliance NU BESS Limited (formerly known as Maharashtra Energy Generation Limited)," the firm said in a stock exchange filing.

On November 6, SECI announced the banning of Reliance Power and Reliance NU BESS from participating in SECI tenders for three years for submitting "fake documents". Reliance Power said it had challenged SECI's ban notice in the Delhi High Court.

Earlier this month, SECI said in a statement that the ban was due to the alleged submission of false documents by companies owned by Anil Ambani. These documents were submitted for tenders issued by SECC in June to set up 1,000 MW/2,000 MWh independent base projects. The tender process was later cancelled.

After reviewing documents filed by Reliance NU Base Ltd, which was previously known as Maharashtra Energy Generation Ltd, the body stated it discovered a bank guarantee backed by a foreign bank against an earnest money deposit was forged.
