Jagran correspondent, Patna: A Public Interest Litigation (PIL) has been filed in the Patna High Court demanding an impartial inquiry into the death of youth Bharat Bhushan Tiwari in an alleged police encounter in Shahpur police station area of Bhojpur district and legal action against the guilty police officers.
Advocate Mukesh Kumar has filed a petition demanding an independent investigation into the matter and the bringing to justice of the responsible officials.
The advocate has appealed before the division bench of Chief Justice Meenakshi Madan Rai for a speedy hearing of this case.
Petitioner seeks answers to why wasn't he arrested
The petition alleges that before the incident, a video of Bharat Bhushan Tiwari went viral on social media, in which he was allegedly seen brandishing a weapon.
The petitioner says that if the police had sufficient information, then why was he not arrested, nor was any weapon recovered?
The petition states that the youth died in an alleged police encounter the very next day, which raises serious questions about the entire incident.
Need for fair investigation
Advocate Mukesh Kumar claims that, prima facie, this case appears to be murder, and an impartial investigation is necessary.
He alleged that if a person has surrendered and despite that he is shot at, then accountability should be fixed and an FIR should be lodged against the concerned police officers.
At the same time, the police claim that 10-12 rounds of firing were done by Bharat Bhushan Tiwari, after which retaliatory action had to be taken in self-defence.
Based on a preliminary investigation following the incident, four policemen and the Shahpur police station in charge have been suspended. The state government has announced a retired High Court judge will investigate the case, although a formal notification has not yet been issued.
