BPSC Exam Row: The Supreme Court on Tuesday refused to hear a plea seeking the cancellation of the 70th Combined Competitive Exams (preliminary) conducted by the Bihar Public Services Commission (BPSC) on the grounds of an alleged paper leak and told the petitioner that he should have first approached the Patna High Court.
A three-judge bench presided by Chief Justice of India Sanjiv Khanna said that the Supreme Court cannot be the court of first instance in every matter and that they should move the high court. The counsel appearing for the petitioner Anand Legal Aid Forum Trust sought to draw the court’s attention to the police lathi-charge on those protesting the alleged leak. He told the bench also comprising Justices Sanjay Kumar and K V Viswanathan that “the entire nation has seen how the Bihar Police has brutally lathi charged the protesters,” as quoted by an Indian Express report.
The bench said in its order, “We feel that it will be appropriate and more expeditious that the petitioner approaches the Patna HC by way of a petition under Article 226 and therefore refuse to entertain the present writ petition”.
BPSC Exam Row: Prashant Kishor Hospitalised
Jan Suraj party founder Prashant Kishor was taken to the hospital on Tuesday after his health deteriorated last night. Kishor is on a fast-unto-death at Gandhi Maidan, in support of the protesting aspirants demanding a re-examination of the preliminary BPSC exam, citing several paper leak reports.
Earlier on Monday, Prashant Kishor was arrested by the Bihar police for an "illegal" fast unto death. However, he was later released on an unconditional bail. The state police had arrested him, citing the Patna High Court order that clarifies that any such demonstration in the city is prohibited at a place other than Gardani Bagh locality.
The police added that a case was filed against the founder of Jan Suraj for holding his protest at Gandhi Maidan. Prashant Kishor has been protesting in support of students since January 2 after the students were dispersed by the police using lathi charge and water cannon.
Kishor was produced before a Patna court on the same day in connection with the case, where he was granted bail. However, the court asked Kishor to submit a written undertaking that he will not participate in any "illegal" protest in the future.
