The Delhi High Court has issued an important directive stating that airport customs officers must not seize passengers’ old or personal jewellery without valid reason. This ruling aims to protect international travellers especially Indians returning home from unnecessary harassment over personal ornaments.

A bench led by Justice Prathiba M Singh and Justice Rajnish Kumar Gupta made the observation during hearings on over 30 petitions. These were filed by travellers who claimed their personal jewellery was confiscated unfairly by customs officers at Indian airports as per a report by Jagran.com.

Court Calls for Sensible Handling Until Baggage Rules Are Updated

The Central Board of Indirect Taxes and Customs (CBIC) told the court it needs more time to update the baggage rules, as it is currently consulting with various stakeholders. Until the revised rules are finalised, the court has ordered that a Standard Operating Procedure (SOP) be put in place and submitted by 19 May.

This temporary SOP will act as a guideline for customs officials, ensuring that travellers are not subjected to unnecessary trouble over personal belongings.

Jewellery That’s Personal or Worn Should Not Be Confiscated

The High Court stressed that jewellery worn by passengers or clearly meant for personal use should not be treated as excess or taxable goods. It also urged the customs department to approach such matters with greater sensitivity, particularly when dealing with women or elderly travellers wearing traditional or sentimental items.

The court remarked that passengers should not face difficulty when entering India, and that customs officers must follow a fair and respectful approach until the baggage rules are formally changed.
