In its submission before the trial court, the CBI alleged that Arvind Kejriwal did not co-operate with the investigation and deliberately gave evasive replies, which the agency said were contrary to the evidences on record. On the other hand, Kejriwal, in his fresh plea before the high court, has claimed tha the CBI acted with malice to create a false basis for arrest.

No proper justification or reasoning was provided for the arrest, especially considering the investigation has been ongoing for two years, Arvind Kejriwal has said in his petition before the high court. The AAP chief was arrested by the CBI on June 26 from Delhi's Tihar Jail, where he was lodged in judicial custody in connection with the Enforcement Directorate's probe into the money-laundering aspect of the excise policy "scam".

While refusing to declare Kejriwal's arrest by CBI illegal, the trial court on June 26 said that "the timing may be circumspect but it is not the clear criterion for declaring an arrest illegal". "Investigation is the prerogative of the investigating agency, however, there are certain safeguards provided in the law and at this stage, on the material on record, it cannot be said that the arrest is illegal. The agency, however, should not be overzealous," the trial court was quoted as saying by news agency PTI.
