The Election Commission of India (ECI) on Monday fact-checked the Congress leader and LoP Lok Sabha, Rahul Gandhi, over his allegations against Chief Election Commissioner Gyanesh Kumar linked to the "Form 6" order, terming them "misleading".

The poll body asserted that a declaration was attached to the form through its Bihar Special Intensive Revision (SIR) order which was upheld by the Supreme Court. The EC's response came on Gandhi's claim that the Chief Election Commissioner "changed Form 6 illegally and unilaterally".

"Fact Check | The statement made in this post is misleading. The order for SIR in Bihar issued on 24 June 2025 was issued with the unanimous approval of the Commission. This order has been upheld by the Hon'ble Supreme Court of India in its judgment dated 27 May 2026," the EC said in an X post.

"In its Press Note No. 120 dated 26 September 2026, in Point 1(iii), ECI has stated that, "The declaration attached to Form 6 for SIR has been upheld by the Hon'ble Supreme Court," it added.

The EC also rejected claims that it has withdrawn the September 26 press note from its website. It shared link of the press note to assert that the statement was still available.

What Has Rahul Gandhi Claimed?

Earlier in the day, Gandhi, in a post on X, claimed that it is now established beyond doubt that CEC Kumar "changed Form 6 illegally and unilaterally".

"It is now established beyond doubt that Gyanesh Kumar changed Form 6 illegally and unilaterally. This is just one more proof of him abusing his position to help the BJP. He and everyone else involved in this criminal assault on our democracy will be held accountable," the Congress leader's X post read.

SC's Clarification On Form 6 Row

The Supreme Court on Monday said that it has not approved any modifications to Form 6 being used by the EC during the SIR of electoral rolls in various states. A bench of Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana said, "Any modification to Form 6 has not been approved by us. Let's be clear. When records are produced, we would like to see who has modified it".

What Is Form 6?

Form 6 is a part of the SIR form, which seeks details of parents of those applying for enrolment. The declaration requires new applicants to furnish details linking themselves or their parents or grandparents to electoral rolls prepared during an earlier intensive revision.

EC Withdraws Form 6 In States Where Exercise Is Over

On September 25, the Election Commission withdrew the additional SIR-related declaration from the online voter enrolment Form 6 in states where the Special Intensive Revision of electoral rolls has been completed, days after the full Commission decided that the requirement would apply only during the exercise. Form 6 remains available on the ECINET portal in states and Union Territories where the SIR is underway.
