Two days after a woman biker was thrown off her motorcycle when a car allegedly hit her on Golf Course Road in Haryana's Gurugram, the lawyer representing the man behind the wheel has claimed that his client is the 'victim'. The woman can be seen in a video skidding across the road and suffering minor injuries to her hands and leg after his speeding Ciaz allegedly rammed into her Aprilia RS 457.

Bainsla's lawyer has alleged that his client was provoked by the woman (Sia) and other riders, harassed and manipulated, making him the victim.

The lawyer representing Kalyan, identified as Naveen Bainsla, said his client was not at fault. Blaming the riders, he said, "My client is not at fault. These riders were overspeeding. The accident happened because of them."

Why Didn't Kalyan Bainsla Stop After Hitting the Woman Biker?

According to a NDTV report, when asked why his client didn't stop to help the woman, the advocate said, "He feared being lynched by a mob. He fled to prevent any untoward incident from occurring to him or his family."

Meanwhile, the biker had alleged that she was targeted because she is a woman biker and that there was a deliberate attempt to stop her. She claimed that her life could have been lost and that the accused did not even attempt to check if she was safe following the accident.

Sia said that Bainsla did not stop for even a second after hitting her with his car. "I feel ashamed of such people. Women feel unsafe on the roads of Delhi and Gurugram," she added.

However, the lawyer claimed that the riders outnumbered his client and were overspeeding. He also alleged that the video evidence shared by Sia and another rider was "edited and planted" to suit their narrative.

"There were 25-30 riders. These videos are edited and planted... The riders were more in number. They were riding at 120-160 kmph."

"Who gives permission to these riders to cover an entire stretch of road, to perform stunts on the road, overspeed and risk people's lives?" Bainsla questioned.

When questioned again about the dashcam footage, which shows the car moving from the first lane to the third lane towards the motorcycle and striking it from the side, Bainsla said he had seen the video four times and that it is evident that the woman rider was overspeeding.

"My client came from behind. He saw a U-turn ahead of him, and to protect himself, he took a left," the advocate said.

"Riders were provoking him, harassing him, and manipulating him. He didn't say anything. He just said, 'You ride well; ride safely.' He didn't hit them. Kalyan took left to save himself," he reiterated.

The lawyer has argued for legal proceedings against the bikers who, according to him, don't follow the law.

Kalyan Bainsla was arrested from Rajgarh in Rajasthan on Tuesday.

On the arrest of accused Kalyan Bainsla, Sandeep Kumar, DCP East Gurugram, says, "...As soon as the video came to the knowledge of the Police, we took suo motu cognisance and filed an FIR. On the basis of the glimpse of the accused in the video, a search was launched, and it was found that he is from Palwal. Three teams of the police were formed, and all three teams worked overnight. He has been arrested from Dausa now. There was another person with him who was present with him at the time of the incident. His role is being examined..."

'I was travelling with my family': Kalyan Bainsla

Bainsla, a gym owner who describes himself as an international kabaddi player, said he fled the spot because he feared that the group of bikers would beat him and his family. He has also deactivated his Instagram account following the controversy.

"I was travelling with my family. I didn't make any gestures at the young woman; I simply asked her to ride her bike slowly. I admit that a collision occurred. Had I stopped right then, those people would have beaten us up," he told the media.

Bainsla said he was travelling with his sister and two cousins.

Kalyan Bainsla's Cousin Detained for Obscene Comments at Sia

A distant cousin of Kalyan Bainsla has been detained for allegedly making obscene comments at her, police said on Monday.

Bainsla's cousin, Lavnish Bainsla, was inside the sedan, which had black-tinted windows, as it drove parallel to Sia's motorcycle.

"The role of the other person is currently being investigated. It is established that he was present with the accused at the time of the incident. As the investigation progresses, further details regarding his role will be shared," a police officer said.

What Happened

The biker has been identified as Shivani Chauhan. The biker, who identifies herself as Sia (Instagram handle: rebelwheels_sia_), had earlier released a video on social media, levelling serious allegations against Bainsla. Following this, Gurugram Police added the charge of attempt to murder (Section 109 of the BNS) in the case, which carries a provision for imprisonment of up to 10 years.

Sia had shared a video recorded on an action camera mounted on her motorcycle. She alleged that a car repeatedly followed her while she was riding with a group of bikers on Sunday before hitting her motorcycle and fleeing the scene.

She alleged that the occupants appeared to be intoxicated and that the driver asked her to stop despite her asking him to maintain a safe distance. She said she continued riding ahead because she felt the situation was unsafe.

Sia said one of her friends chased the car and confronted the driver at a traffic signal. According to her, the driver denied responsibility and drove away.

The car owner has been identified as Manish, who said that the vehicle belonged to him but had been borrowed by his friend Kalyan Singh two days earlier.

Manish said he was at work and learnt about the accident only on Monday morning. He said Singh did not answer his calls when he tried to contact him.

Sia is a resident of Delhi, has completed a course in fashion designing and also contested the 2022 municipal elections from Kalkaji. Her father, Roshan Chauhan, is a member of the Aam Aadmi Party.
