Mukesh Thakur, West Delhi: A Delhi Court has issued a notice to the SHO of the Uttam Nagar police station and summoned an Action Taken Report (ATR) in the murder of Tarun Kumar, who was lynched in the locality on the night of Holi.
The Judicial Magistrate First Class (JMFC) court of Dwarka issued a notice to the SHO after the suspect claimed to be a minor. The deceased Tarun's family has alleged that the accused's family prepared a fake birth certificate to prove he wasn't an adult, but despite their complaint, the police did not register an FIR.
Tarun's uncle files complaint
Tarun's uncle, Tekchand, filed a complaint in court through advocate Sumit Chauhan. The complaint alleges that the main accused's mother, father, and maternal grandfather fabricated documents to portray him as a minor.
The complainant stated that he had submitted a written complaint to the Uttam Nagar police station and the Dwarka Deputy Commissioner of Police, but no action was taken at any level, which prompted them to approach the court.
According to the complaint, a birth certificate of the accused was found during the investigation, showing his date of birth as October 7, 2007, and was registered in 2008.
Based on this record, his age at the time of the murder is approximately 18 years and five months.
It is alleged that a second birth certificate was prepared in 2018, in which the date of birth was recorded as October 7, 2011, in an attempt to show him as a minor. The complainant claims that this document was also provided to the police after it was obtained.
Next hearing on September 15
At a hearing on Wednesday, Judicial Magistrate Deeksha Sethi directed the SHO to file an ATR before the next hearing. The court asked the police to clarify whether a complaint was received, whether it constitutes a cognisable offence, what action was taken, whether an FIR was registered, and the reasons for the delay. The court scheduled the next hearing for September 15.
Due to a dispute regarding the age of the accused, the appellate court has ordered a stay on the pending proceedings in the JJB until August 1. The appellate court is scheduled to hear the matter on the same day.
