A US appeals court upheld two earlier decisions of the Patent and Trademark Office that sided with Masimo, who is fighting with Apple in an intellectual property conflict that concerns the latest Apple Watch lineup and their blood oxygen sensors. This decision of the Court of Appeals for the Federal Circuit involves the finding of the tribunal.

This update comes as Apple continues to deal with the decision of the Apple Watch import ban in the US. According to Reuters, the import ban imposed by the International Trade Commission (ITC) is on hold as Apple has challenged the move. The medical tech company and the iPhone maker are engaged in a legal tussle in which Masimo claims that Apple infused the blood oxygen monitoring technology into its wearable.

As a result, the company had to pull out its Apple Watch Series 9 and Watch Ultra 2 from the Apple website in the US last month. However, the ban was short-lived and imports were temporarily paused. According to Bloomberg, the company is planning a "rescue" mission worth $17 billion that ranges from software updates and other walkarounds.

The report noted engineers are working in full swing to make changes to the blood oxygen monitoring technology. The tweaks may include adjustments in how the option calculates the results and present the data. On a related note, the Watch Series 9 also offers a heart rate monitoring sensor, ECG app, high and low heart rate notifications, irregular rhythm notifications, temperature sensing, altimeter, compass, accelerometer and more sensors.
