The Lucknow bench of the Allahabad High Court has stayed the single bench’s order for fresh counselling in four government medical colleges of Uttar Pradesh, while upholding the cap of 50 per cent on reservation.

A division bench of Justice Rajan Rai and Justice Manjiv Shukla passed the interim order after hearing a special appeal filed by the state government against the single bench’s decision to quash several government orders that had allowed more than 79 per cent reservation in Ambedkarnagar, Kannauj, Jalaun and Saharanpur medical colleges.

The court directed the state government to submit an affidavit within a week, assuring that the 50 per cent reservation ceiling will not be breached from the next academic session. The bench clarified that if the affidavit is not filed, the interim relief will lapse.

The court also ordered that students from SC-ST categories, who were admitted beyond the reservation limit in the four colleges, be adjusted against 82 vacant reserved seats available in other medical colleges.

Senior advocate J N Mathur, appearing for the state, argued that re-counselling would displace candidates who had already secured admission and create complications as admissions in other colleges are nearly complete. On the other hand, petitioner’s counsel Motilal Yadav contended that under the state quota of 85 seats in each college, only seven were kept for unreserved candidates.

Earlier, Justice Pankaj Bhatia had held that the government orders issued between 2010 and 2015 led to excessive reservation and ordered fresh counselling in the four medical colleges, which the division bench has now put on hold.
