The Ministry of Education (MoE) instructed all Central Educational Institutions (CEIs) to fill vacancies strictly in accordance with the 2019 ACT on Sunday, clarifying that no reserved posts can be de-reserved following the draft recommendations by the University Grants Commission (UGC).

In line with the Central Educational Institutions (Reservation in Teachers' Cadre) Act of 2019, the ministry emphasised that reservations are offered in Central Educational Institutions (CEIs) for all positions in direct recruitment in the teacher cadre.

"Reservation in Central Educational Institutions (CEI) is provided for all posts in direct recruitment in Teacher’s cadre as per the Central Educational Institutions (Reservation in Teachers’ Cadre) Act, 2019. After enactment of this Act, no reserved post is to be de-reserved. Ministry of Education has given directives to all the CEIs to fill up the vacancies strictly as per the 2019 ACT," tweeted the Ministry of Education.

"This is to clarify that there has been no de-reservation of reserved category positions in CEIs in the past, and there will be no such de-reservation in the future. It is important for all higher education institutions to ensure that all backlog positions in the reserved category are filled through concerted efforts," said M Jagadeesh Kumar, Chairperson of the University Grants Commission.

According to the Department of Personnel and Training circular, candidates who belong to Scheduled Castes (SC), Scheduled Tribes (ST), or Other Backward Classes (OBCs) may apply for a position that has been designated for them.

Furthermore, it stated, "However, a reserved vacancy may be declared unreserved by following the procedure of de-reservation as given below; therefore, it can be filled as an unreserved vacancy."

According to the circular, in instances deemed "rare and exceptional cases," vacancies in Group A positions cannot remain unfilled due to public interest.

The draft guidelines specify that proposals for de-reservation concerning Group C or D positions should be directed to the University's Executive Council. Conversely, for Group A or B positions, such proposals must be submitted to the Ministry of Education, accompanied by comprehensive details, for requisite approval. Following approval, the vacant posts may be filled, and reservation provisions may be continued.
