The Supreme Court will give its verdict on Friday on the petition challenging the CBI's arrest of Chief Minister Arvind Kejriwal in connection with the corruption in the Delhi Excise Policy Case. The bench of Justice Surya Kant and Ujjwal Bhuiyan had reserved the verdict after hearing the arguments on the case on September 5.

If the Supreme Court grants bail to Kejriwal in the CBI case, he will be free to walk out of jail as he has already got interim bail from the Supreme Court in the money laundering case. The CBI arrested Kejriwal on June 26 when he was already in jail in the ED money laundering case.

Kejriwal Challenged Delhi High Court Order In Supreme Court

Arvind Kejriwal has challenged the Delhi High Court's order in the Supreme Court. The High Court rejected Kejriwal's petition challenging the CBI arrest and asked him to go to the lower court for bail. Kejriwal has challenged both the orders in the Supreme Court.

Kejriwal has demanded his release and bail in the petitions, calling the CBI arrest illegal. Senior advocate Abhishek Manu Singhvi, appearing for Kejriwal, had questioned the arrest and argued that it is illegal to arrest him directly without sending a notice for interrogation under section 41A of the CRPC and that he should be released.

CBI Has Right To Investigate And Arrest

The Supreme Court has said in many of its decisions that bail is the rule and jail is the exception. Kejriwal is in a constitutional position and there is no possibility of him running away after getting bail. While justifying the arrest, the CBI said that Kejriwal was not cooperating in the investigation and was misleading the investigating agency, so he was arrested and the CBI has the right to investigate and arrest.

CBI Said That Kejriwal Can Tamper With Evidence

CBI had raised a preliminary objection to Kejriwal's bail plea and said that he should have first approached the sessions court for bail and he went directly to the High Court which is not right. It had also said that if Kejriwal gets bail, he can try to influence the case by tampering with the evidence.
