Bengaluru News: A Bengaluru woman’s online food order resulted in a legal case after she found prawn pieces inside a sandwich labelled vegan. The Bengaluru Urban District Consumer Disputes Redressal Commission has now directed Swiggy and the restaurant, Paris Panini, to jointly pay Rs 1 lakh as compensation for negligence.

The complainant, 37-year-old Nisha G, has been a vegetarian all her life and later adopted a vegan lifestyle out of concern for animals. On July 10, 2024, she ordered a vegan sandwich from Paris Panini through Swiggy. According to the Times of India report, she took a bite and immediately sensed something unusual. When she checked the filling, she discovered pieces of prawn inside. The incident left her distressed and she later performed cleansing rituals due to her strict dietary beliefs.

The following day, Nisha visited the restaurant to raise her concern. The outlet manager admitted that a mix-up had occurred, blaming it on a rush of customers. A replacement sandwich was offered, but Nisha declined, saying that the experience had left her “humiliated and spiritually violated.”

After sending legal notices on July 20, 2024, which received no response, Nisha filed a consumer complaint on August 22, accusing both Swiggy and the restaurant of service deficiency and breach of trust. She demanded Rs 2 lakh in compensation.

Swiggy argued that it acted only as a platform connecting customers and restaurants and should not be held responsible for the error. Paris Panini accepted that a mistake had occurred but called it unintentional. The restaurant also claimed that “a normal vegan would not have chosen” their outlet since they serve both vegetarian and non-vegetarian dishes.

The consumer commission rejected these arguments. It ruled that delivering non-vegetarian food to someone who follows vegan or religious dietary restrictions “cannot be taken lightly,” adding that such errors carry emotional and psychological impact.

The commission ordered Swiggy and Paris Panini to pay Rs 50,000 as compensation, Rs 50,000 for mental agony, Rs 5,000 towards litigation costs, and refund the Rs 146 spent on the sandwich, along with 12 per cent annual interest until payment is completed.
