The petition of some accused in the Uttar Pradesh fake madrasa case was rejected by the Lucknow bench of Allahabad High Court on Friday. The court agreed with the SIT report and the FIR lodged against them for allegedly misusing funds for 39 nonexistent madrasas in Azamgarh. 

The court said there is a prima facie case of cognizable offence in the matter and the investigation cannot be interfered with at this stage. The court also noted that the SIT had found irregularities in 313 madrasas, which did not meet the prescribed standards and did not have proper recognition documents.

The petitions were filed by Javed Aslam, Lalman, Om Prakash Pandey, Mohd Sarfaraz Ahmed and Munnar Ram, who were named in the FIR filed in Lucknow in 2019. They challenged the SIT report that was given to the government on November 30, 2022 and the action taken by the government based on it.

The accused claimed they were falsely implicated in the case and that the SIT had not conducted a detailed inquiry. They had sought quashing of the FIR and the SIT’s report.

The state government opposed their pleas and argued that the FIR was based on concrete evidence of fraud, forgery and cheating. The state government also said the matter was of public interest and involved public money. Therefore, the court rejected their petitions and allowed the investigation to continue.
