In a significant move, the Uttar Pradesh government has permitted conditional mixed-use development on residential plots under the newly implemented Uttar Pradesh Development Authority Building Construction and Development By-laws–2025. For the first time, residential plots located along wide roads in urban areas can be partially used for commercial or office purposes, provided certain conditions are met.
According to the by-laws, residential plots on roads at least 18 meters wide in cities with a population of up to 10 lakh, and 24 meters wide in larger cities (as per the 2011 Census), are eligible for mixed use. However, commercial construction will be capped at 49 per cent of the total built-up area. A minimum of 51 per cent of the construction must remain designated for residential purposes.
The rules also allow for both shops and offices on the same plot, but with a specific breakdown: 33 per cent of the construction can be used for shops, 33 per cent for offices, and the remaining 34 per cent must be reserved for residential use.
There will be no minimum plot size requirement for mixed-use approval. However, building height will be governed by the applicable Floor Area Ratio (FAR) as per local land use regulations. Parking provisions must also adhere strictly to the type of usage proposed on the plot.
