A courtroom drama is about to unfold in a high-profile trial between Elon Musk and his co-founded company OpenAI, which is led by Sam Altman. The trial commences April 27, 2026, which is today, in a federal court in Oakland, California, starting off with jury selection. This case will be overlooked by Yvonne Gonzalez Rogers and is expected to last at least two to four weeks.

The judge had labelled this case as a "billionaires versus billionaires" in last year's proceedings. Originally the lawsuit was filed by Elon Musk in the year 2024, and since then the case has been no less than a courtroom drama, and it has had its experience of twists and turns before the case even got to the courtroom. Let's take a deeper look at why this trial is taking place in the first place.

Why Is Musk Suing OpenAI

The lawsuit was originally filed by the founder of Tesla, Elon Musk, in 2024, and the charges levied against the firm were that it had abandoned the core philosophy and commitment with which OpenAI was founded, which was to develop artificial intelligence for the public good and not for profits with its deep partnership with tech giant Microsoft. With that, Microsoft was also dragged into the case.

Musk has argued that his contribution amounted to $38 million to OpenAI when the company was just starting off, and the understanding between the two was that the technology that was developed would remain open source and would be developed for the upliftment and benefit of humanity. “Elon Musk’s case against Sam Altman and OpenAI is a textbook tale of altruism versus greed. Altman, in concert with other defendants, intentionally courted and deceived Musk, preying on Musk’s humanitarian concern about the existential dangers posed by AI,” the lawsuit filed by Musk reads.

The lawsuit further mentions that top officials of OpenAI, Sam Altman and President Greg Brockman, "preyed on Musk’s well-known concerns about the existential harms posed by AI/AGI and convinced him to fund and back what they falsely claimed would be a ‘nonprofit’ devoted to the safe and open development of AI.”

Musk has put up a demand of $138 billion for compensation, as well as the removal of Sam Altman from the position of CEO.

What Was OpenAI's Response?

The firm has rejected the allegations levied against it and has accused Musk instead of running a "harassment campaign", which is motivated by self-interest, with a hidden desire to clear the path for its own AI venture xAI.

"Elon donated $38 million to the OpenAI nonprofit, which was spent exactly as intended and in service of the mission. Despite claiming and receiving a tax deduction for this donation, he's now asking the court to treat it as an investment that entitles him to significant ownership of OpenAI," OpenAI wrote in a blog post.

The company, OpenAI, claims that it still has the same motive in mind that is "creating AGI that benefits all of humanity", iterating that this lawsuit is more out of rivalry than principle.

The case is likely to stretch on for weeks and may influence how AI firms balance their original missions with the business pressures that come with scaling advanced technology.

For Elon Musk, a favourable outcome could deal both legal and reputational damage to OpenAI, an organisation he once supported but now competes with. On the other side, OpenAI faces serious risks too. An unfavourable ruling could create hurdles for raising funds, reshaping its governance, and maintaining ties with Microsoft, which has invested heavily in the company.
