In the Twisha Sharma death case, mother-in-law Giribala Singh had demanded Rs 2 lakh at the time of 'vidai' when her son Samarth Singh married Twisha in December. This is one of the charges against the former district judge in the FIR filed by the Central Bureau of Investigation.
The Madhya Pradesh Special Investigation questioned Sharma's husband Samarth Singh for over three hours. The advocate reiterated his claim that his wife was "distressed" after the abortion.
The MP police said that the SIT, as part of their investigation, recreated the crime scene and interrogated Singh. He claimed that their marriage had started deteriorating when Sharma learnt about her pregnancy. The accused repeatedly tried to mislead the officers when asked about his abscondence. The MP advocate also claimed that he gave a sum of Rs 7 lakh to Sharma.
During the investigation, the team seized Samarth's laptop, phone, Aadhar card, and other documents.
CBI Lodges FIR
The CBI on Monday lodged an FIR in the case and formally took over the investigation after the Supreme Court bench led by Chief Justice of India Surya Kant handed over the probe to the central agency.
The CBI booked Twisha Sharma’s husband and her mother-in-law, former district judge Giribala Singh, invoking sections 80(2), 85, and 3(5) of the Bharatiya Nyay Sanhita along with sections of the Dowry Prohibition Act, which were levelled by the state police as well.
What Did Twisha's Family Say
As per the statement given to the police at the time of filing the FIR, Twisha's family said that she had spoken to her mother at 9.41 pm.
During the call, her husband was heard shouting, and the call was cut abruptly, the FIR citing the statement alleged.
After repeated calls, Giribala Singh picked up the phone and told Twisha's sister-in-law that "she is no more" and cut the call, it is alleged.
The central probe agency initiates an investigation, referred by the state police, by re-registering the police FIR, which serves as the starting point of the investigation.
'Better To Have Divorced Daughter Than Dead'
The Supreme Court on Monday took over the case from the MP High Court after multiple legal battles connected to the case unfolded simultaneously. After hearing arguments from lawyers representing Twisha’s family, the accused side and the state government, the court ordered a centralised CBI investigation and asked the agency to proceed expeditiously.
The apex court has asked both Sharma and her husband's family to avoid speaking to the media while the investigation remains underway. The court said that this would maintain the integrity of the CBI inquiry.
Solicitor General Tushar Mehta, appearing for the Madhya Pradesh government, remarked that "a divorced daughter is better than a dead one".
Giribala's Bail Has Been Challenged
The legal battle has now intensified around the anticipatory bail granted to Twisha’s mother-in-law, Giribala Singh. Both the Madhya Pradesh government and Twisha’s father have challenged the bail order. Notices have already been served, and the matter is now set for hearing on May 27 at 2:30 pm.
Twisha Sharma (32) was allegedly found hanging at her in-laws' home in Bhopal on May 12. While her in-laws and an autopsy report have claimed that she died by suicide, her family alleges foul play.
